TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Texas Warriors Compass website, programs, events, communications, and related services (collectively, the “Services”). Texas Warriors Compass (“Texas Warriors Compass,” “we,” “us,” or “our”) is a Texas Domestic Non-Profit Corporation (File Number 0806295653).

By using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who We Are and What We Do

Texas Warriors Compass provides nonprofit services that may include veteran hunts, outdoor experiences, volunteer opportunities, fundraising, and community support initiatives. Participation may require applications, screening, safety rules, and eligibility requirements.

2) Eligibility and Participation

You must be able to form a legally binding agreement to use the Services. Certain programs (including hunts and events) may have additional eligibility requirements, waivers, rules, or guidelines. We may require verification of eligibility and may deny or revoke participation at our discretion, including for safety, compliance, or mission alignment.

3) Applications, Scheduling, and Program Changes

Submitting an application does not guarantee acceptance. Event dates, locations, guides, activities, and schedules may change due to weather, safety concerns, land access, staffing, wildlife conditions, or other circumstances. We may reschedule, modify, or cancel any program or event at any time.

4) Safety, Conduct, and Rules

For all hunts, events, and activities, you agree to:

Follow all posted rules, guide instructions, and safety protocols

Use required safety equipment when instructed

Behave respectfully toward veterans, volunteers, landowners, guides, and staff

Avoid illegal activity, threats, harassment, intoxication, or unsafe conduct

We may remove any participant or volunteer from an event or restrict access to Services for violating rules or creating a safety risk. No refunds or reimbursements are guaranteed in these situations.

5) Weapons, Hunting, and Legal Compliance

Where applicable, you are responsible for complying with all federal, state, and local laws, including licensing, permits, hunter education requirements, firearm laws, transportation rules, and land-use rules. You agree not to bring prohibited items to events. We may impose additional restrictions for safety.

6) Assumption of Risk

Outdoor activities, hunting, travel, and related events involve inherent risks, including injury, illness, property damage, weather hazards, wildlife encounters, uneven terrain, equipment hazards, and vehicle or firearm-related risks.

By participating, you acknowledge and accept these risks. You are responsible for your own decisions and actions during participation.

7) Waivers and Releases

Some Services may require signing additional waivers, releases, assumption-of-risk agreements, medical disclosures, media releases, or landowner rules. Those documents are incorporated by reference into these Terms. If you do not sign required forms, you may not participate.

8) Donations, Payments, and Refunds

Donations help fund our mission and may be processed through third-party payment providers. Unless expressly stated otherwise in writing:

Donations are voluntary and generally non-refundable

If an event is canceled or changed, donations are not automatically refundable

If you believe a donation was made in error, contact us promptly at (903) 452-8150 and we will review on a case-by-case basis

9) Volunteer Terms

Volunteers agree to follow instructions and safety rules and to represent the organization professionally. Volunteer roles may involve physical activity and travel. We may accept or decline volunteers and may end volunteer participation at any time.

10) Intellectual Property

Our website content, text, photos, videos, logos, and branding are owned by Texas Warriors Compass or used with permission and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit our content without prior written permission, except for personal, non-commercial use.

11) User Content and Submissions

If you submit content (messages, testimonials, photos, videos, or other materials), you represent that you have the right to share it. Unless you explicitly state otherwise in writing, you grant Texas Warriors Compass a non-exclusive, royalty-free license to use your submission for nonprofit purposes such as promotion, storytelling, outreach, and fundraising.

12) Privacy

Your use of the Services is also governed by our Privacy Policy. Please review it for details on how we collect and use information.

13) Third-Party Links and Services

Our Services may link to third-party websites or tools (e.g., donation platforms, social media). We do not control and are not responsible for third-party content, policies, or practices. Use them at your own risk.

14) Disclaimers

The Services are provided “as is” and “as available.” We do not guarantee that the website will be uninterrupted or error-free. We do not make guarantees regarding outcomes of any program, event, hunt, or experience.

15) Limitation of Liability

To the fullest extent permitted by law, Texas Warriors Compass will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the Services or participation in programs/events.

To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim (or, if no payment was made, $100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless Texas Warriors Compass and its directors, officers, volunteers, agents, and partners from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your participation in events, your violation of these Terms, or your violation of any law or third-party rights.

17) Suspension and Termination

We may suspend or terminate access to the Services at any time if we believe you violated these Terms, created a safety risk, engaged in misconduct, or used the Services unlawfully.

18) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Continued use of the Services after changes means you accept the updated Terms.

19) Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms will be brought in state or federal courts located in Texas, unless otherwise required by law.

20) Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, along with any posted policies (including the Privacy Policy) and any program-specific waivers you sign, form the entire agreement between you and Texas Warriors Compass regarding the Services.
